First Nations Jurisdiction Over Education

First Nations Education Authority (FNEA)

The First Nations Education Authority (FNEA) is a central body which will be delegated areas of responsibilities by Participating First Nations (PFNs). The collective nature of the FNEA will ensure that there is adequate support for smaller First Nations and will provide a more strategic approach to some components of Jurisdiction for all PFNs.

First Nations have provided direction regarding the role of the FNEA and as all PFNs will have seats on the FNEA they are all part of determining standards. Some of the powers which have been considered for delegation to the FNEA include;

  • Teacher Certification
  • School Certification
  • Curriculum and Standards

The purpose of the FNEA is to provide support to First Nations who wish to exercise Jurisdiction over education. The FNEA will not have inherent jurisdiction and will only exercise jurisdiction in areas that have been delegated to it by PFNs.

The FNEA will also be instrumental in providing templates for First Nations Education law, Terms of Reference for a Community Education Authority (CEA) and other required documents. Funding for the FNEA will be negotiated annually, or an on agreed frequency, with Canada.
